A. REAL ESTATE DEVELOPERS / PROMOTERS – MANDATORY COMPLIANCE

  • 1. No promoter shall advertise, market, sell, book, offer for sale, invite persons to purchase, or engage in any promotional activity for plots, apartments, buildings, or any real estate project (or part thereof) within any planning area without: o Registration under RERA for projects exceeding 500 square meters or comprising more than eight units; and o Obtaining necessary approvals from concerned departments.
  • 2.The RERA registration number and the Authority’s website address, where project details are available, must be prominently displayed in every advertisement or prospectus issued by the promoter.
  • 3. Any promoter who fails to register a project as required under the Real Estate (Regulation and Development) Act shall be liable to a penalty of up to 10% of the estimated project cost. Continued violation may result in imprisonment for up to three years, or a fine, or both.
  • 4. If any project is found to be unregistered under Section 3 of the Act and falls within the jurisdiction of RERA Bihar, a show-cause notice shall be issued to the promoter. The promoter must submit a reply within 15 days, failing which action will be taken under Section 59 of the Act.

B. REAL ESTATE AGENTS / BROKERS / MEDIATORS – COMPLIANCE REQUIREMENTS

  • 1. Every real estate agent, broker, or mediator must be registered with RERA. Facilitating the sale or purchase of any plot, apartment, or building without such registration constitutes a violation and attracts penalties under Section 62 of the Act.
  • 2. A registered real estate agent shall not facilitate the sale or purchase of any plot, apartment, or building in a project that is not registered with RERA Bihar.
  • 3. Real estate agents, brokers, and mediators must maintain and preserve books of accounts, records, and documents as required under Section 10 of the Act.

C. GUIDELINES FOR PLOT, FLAT, AND HOUSE BUYERS

1. Buyers and allottees should ensure that the project: • Ensure that the project is registered with RERA Bihar before making any purchase, particularly for projects exceeding 500 square meters or comprising more than eight units.

2. Before purchasing, buyers should verify project details using the RERA registration number on the RERA Bihar website:Click Here They should also review the legal title, approved layout plan, project name, amenities, specifications, location details, approvals, and completion timelines.


3. Any violation by the promoter/builder—such as pre-launch offers, marketing or selling without RERA registration, or lack of statutory approvals—may be reported to RERA Bihar website: Click Here

4. If the promoter: o Fails to hand over possession within the agreed time; o Collects more than 10% advance without a registered agreement of sale; or o Fails to fulfill obligations under the Act; The aggrieved person may file a complaint with RERA Bihar: Click Here
